Prior to hiring a new pastor, a church and its elders have a legal duty to conduct adequate background checks. Any “red flag” raised by prior conduct of the candidate should be thoroughly investigated. The church’s duty does not end once employment begins. After a pastor is hired, church elders and staff have a continuing obligation to supervise the affairs of a pastor, which includes special attention to their contact with minor children.
